1. Acceptance of Terms
These Terms of Service ("Terms") govern your use of the Prompto mobile application, Apple Watch features, and the web dashboard at calendar.promptoapp.co (together, the "Service"). By creating an account, purchasing a subscription, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 13 years old to use the Service. If you are under the age of legal majority where you live, your parent or legal guardian must review and agree to these Terms. Where applicable law requires parental consent for the processing of your personal information, you may use Prompto only with that consent. The Service is not directed to children under 13.
3. The Service
Prompto is a personal productivity and self-improvement service that may help you organize tasks and events, set goals, build routines, track progress, save photos and reflections, and use AI-assisted features. Features may differ by platform, device, region, subscription, or version. Prompto is not a medical, mental-health, legal, financial, or other professional service and is not a substitute for professional advice, diagnosis, or treatment.
4. Accounts
You may sign in through Apple or Google. You are responsible for maintaining the security of your account and devices and for activity under your account. Information you provide must be accurate and current. Tell us promptly at hello@promptoapp.co if you believe your account has been accessed without permission. You may not transfer, sell, or share access to your account.
5. Subscriptions, Trials & Billing
Some or all features may require a paid Prompto Pro subscription. Available plans, prices, trial offers, and eligibility are shown before purchase and may vary by region or account. Purchases made in the iOS app are processed by Apple under the App Store terms that apply to you.
- Payment is charged to your Apple ID when Apple confirms the purchase.
- Unless canceled, a subscription renews automatically for the same period at the price Apple displays to you. Apple generally charges within 24 hours before renewal.
- Manage or cancel through your Apple ID subscription settings. Deleting Prompto or your account does not automatically cancel an Apple subscription.
- Trial offers are available only to eligible users. Unless canceled before the trial ends, the selected paid subscription begins automatically.
- Refunds and billing disputes are handled by Apple, subject to Apple's policies and any rights you have under applicable law.
6. Your Content
You retain ownership of content you submit or create, such as tasks, events, routines, goals, identity content, reflections, photos, recordings, and support reports ("Your Content"). You give Prompto a limited, worldwide, non-exclusive license to host, store, reproduce, transmit, process, and display Your Content only as reasonably necessary to operate, secure, improve, and support the Service and to comply with law. This license ends when the relevant content is deleted from our systems, except for limited backup, legal, or security retention. You are responsible for Your Content and must have the rights needed to provide it.
7. AI-Assisted Features
When you choose an AI-assisted feature, Prompto may send the text, images, instructions, and other context needed for your request to OpenAI. AI output may be inaccurate, incomplete, inappropriate, or unexpected. You are responsible for reviewing output before relying on or using it. Do not use AI output as professional advice or as the sole basis for decisions that could materially affect you or another person. Do not submit information to an AI feature that you do not want processed by OpenAI.
8. Permissions & Device Features
Certain features may request access to your location, microphone, speech recognition, photos, notifications, background activity, or connected Apple Watch. You can refuse or later change permissions in your device settings, although the related feature may then be unavailable. Carrier, internet, and device charges are your responsibility.
9. Acceptable Use
You may use the Service only for lawful, personal purposes. You agree not to:
- Violate law or the rights of another person.
- Upload unlawful, infringing, abusive, malicious, or deceptive content.
- Probe, disrupt, overload, bypass, or interfere with the Service or its security.
- Access another person's account or data without authorization.
- Reverse engineer or extract source code except where applicable law expressly permits it.
- Scrape, resell, sublicense, or commercially exploit the Service without written permission.
- Use the Service or AI features to develop competing models or services, create malware, or facilitate harm.
10. Prompto's Rights
The Service, including its software, design, text, graphics, branding, and other materials excluding Your Content, is owned by or licensed to Prompto and is protected by intellectual-property laws. Subject to these Terms, Prompto grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to use the Service for personal, non-commercial purposes.
11. Third-Party Services
The Service relies on third parties, including Apple, Google Firebase, Google Sign-In, OpenAI, WeatherKit, Vercel, and email and infrastructure providers. Their services and terms may apply separately. Prompto is not responsible for third-party services, websites, content, outages, or actions. Links to services such as Pinterest or map applications are provided for convenience and do not imply endorsement.
12. Changes, Availability & Termination
We may add, change, suspend, or discontinue features and may impose reasonable limits to protect or operate the Service. We may suspend or terminate access if you materially breach these Terms, create risk or harm, or if required by law. You may stop using the Service at any time. Provisions that by their nature should survive termination will survive, including ownership, disclaimers, and limitations of liability.
13. Account Deletion
You may initiate account deletion in Prompto or contact hello@promptoapp.co. Export any data you want to keep before requesting deletion. We will delete or de-identify account data as described in the Privacy Policy, subject to reasonable processing time and information we must retain for security, legal, fraud-prevention, or billing purposes. Deleting your account does not cancel an App Store subscription.
14. Disclaimers
To the maximum extent permitted by law, the Service is provided "as is" and "as available." Prompto disclaims all express, implied, and statutory warranties, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not promise that the Service or its content will be accurate, secure, uninterrupted, error-free, or suitable for a particular result. Nothing in these Terms excludes warranties or rights that cannot legally be excluded.
15. Limitation of Liability
To the maximum extent permitted by law, Prompto will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, opportunities, goodwill, or data, arising from or related to the Service. Where liability cannot be excluded, Prompto's aggregate liability will not exceed the greater of the amount you paid for the Service during the 12 months before the event giving rise to the claim or USD $50. These limitations do not apply where prohibited by law, including liability that cannot legally be limited.
16. Disputes & Local Rights
Before starting a formal dispute, please contact hello@promptoapp.co and allow us a reasonable opportunity to resolve it. These Terms do not limit mandatory consumer rights available where you live. Any dispute may be brought before a court with jurisdiction under applicable law. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
17. Changes to These Terms
We may revise these Terms as the Service or law changes. We will update the date above and provide additional notice when required. Changes apply prospectively. If you do not agree to revised Terms, stop using the Service. Continued use after the effective date means you accept the revised Terms to the extent permitted by law.
